New regulations on employment of foreigners in Poland

The new regulations on the employment of foreigners in Poland came into force in May 2015. These refer to: the Regulation of the Minister of Labour and Social Policy on cases in which the employment of a foreigner on the Polish territory is allowed without the need to obtain a work permit and the Regulation of the Minister of Labour and Social Policy on issuing work permits for foreigners (this new regulation aligns to certain provisions of the Law on employment promotion and labour market institutions, introduced by the new law on foreigners).

The main changes are:
 Extending the right to become employed in Poland without the need to obtain a work permit for foreign students and doctoral students staying in Poland, on the basis of visas issued for studies;
 Access to the Polish labour market during the entire year (not only in holiday months - July, August and September);
 Exempting foreigners giving occasional lectures, speeches or presentations of a scientific or artistic value - regardless of the place of residence of such persons - from the requirement to obtain a work permit;
 Clarifying the rules concerning employers' declarations of intent to hire a foreigner, to ensure that only foreigners with contracts corresponding to the employer's declarations may be employed without a work permit;
 Limiting the persons registered as unemployed to foreigners having priority for employment and integrated on the Polish labour market.

In 2014 the number of foreigners looking for a job, registered with the Polish employment agencies, was 3,900, lower than in 2013, when the figures showed 4,500 foreign unemployed people. Their structure reflects the composition of the foreign population in Poland: most are Ukrainians, followed by Russians and people from Belarus.
